ACGGOODS Copyright Policy

1. General Principles

1.1 Human-Made & Self-Created

ACGGOODS only accepts designs that are original, human-made, and legally authorized. We prioritize manual artistry and independent creative processes.

1.2 Compliance

All artworks and materials submitted must not infringe upon any third-party intellectual property rights, trademarks, publicity rights, or other legal rights.

1.3 Platform Authority

The platform reserves the right to review, remove, or terminate collaborations at any time if a violation is suspected or confirmed.

2. Standards of Originality and “No AI” Policy

To protect the integrity of our creative community, ACGGOODS maintains strict standards regarding production. Any form of AI-generated content is strictly prohibited. This includes:

2.1 Directly selling AI-generated images.

AI-Assisted Tracing: Tracing, inking, or painting over an AI-generated base.

AI Structuring: Using AI to generate compositions, poses, or structures as the primary “skeleton” of a work.

2.2 Tracing and Referencing:

Permitted: Using original photography taken by the artist as a reference for poses, anatomy, or lighting.

Prohibited: 1:1 tracing or “over-referencing” of third-party images (including but not limited to Pinterest, Google, social media, or stock photos not owned by the artist).

Manual Effort Requirement: All final lines and colors must be manually executed by the artist.

3. Artist’s Warranties and Responsibilities

3.1 Proof of Process

Artists are required to retain layered source files (e.g., PSD, Procreate, SAI) and progress records (sketches, drafts, or timelapses). In the event of an inquiry, the artist must provide these files within 48 hours.

3.2 Liability

Any claims or liabilities arising from copyright issues shall be borne solely by the artist. ACGGOODS reserves the right to deduct legal costs and refund expenses from the artist’s unsettled earnings.

3.3 Exclusivity

For “collaboration works,” artists must notify the platform before selling elsewhere.

4. Fan Art and Derivative Works

4.1 Compliance with IP Owners

Artists must respect the guidelines of original copyright holders. Derivative works must stay within “Fair Use” or the allowed scope of the respective IP.

4.2 Unauthorized Works

Fan art that violates specific prohibitions of an IP holder or involves tracing official art will be removed immediately.

5. Prohibited Content

Immediate takedown applies to:

Infringement of copyrights, trademarks, or publicity rights.

Unauthorized use of brand logos, game characters, or celebrity likenesses.

AI-generated or AI-derived works.

Content involving political propaganda, pornography, hate speech, or violence.

6. Complaint and Reporting Procedure

To ensure fairness, ACGGOODS follows a standardized four-step reporting process:

Step 1: User Submission

Reporters must complete the official Report Form and upload evidence.

If evidence is incomplete (excluding optional fields), the report will be rejected immediately.

Step 2: Operational Review

The ACGGOODS team will evaluate the evidence by:

Reviewing the reporter’s evidence and the reported product/shop info.

Comparing social media records and original portfolios of the artists involved.

Outcome A (Confirmed Violation):

Minor/Sensitive: (e.g., IP policy concerns) Contact the owner to suggest voluntary removal.

Severe: (Plagiarism, AI use, stolen art) Notify the owner of the violation. A 7-day appeal window is granted; otherwise, the product is removed and the shop closed.

Outcome B (Inconclusive): Internal team discussion. If evidence is still lacking, the reporter will be asked for supplements before re-evaluating.

Outcome C (Report Rejected): The reporter is notified of the rejection and reasoning. The reported artist is not notified and remains unaffected.

Step 3: Artist Appeal

The reported artist has 7 business days to submit source files, creation timelines, and drafts to prove originality.

Step 4: Final Decision

If an appeal is submitted, the team re-evaluates the case within 7 business days.

If no appeal is filed or the appeal fails, the product will be permanently removed and the account may be terminated.

7. The “Two-Strike” Rule

7.1 First Violation

The product is removed, and a Formal Warning is issued.

7.2 Second Violation

The artist’s account and store will be permanently banned without further appeal.

8. Platform Usage Rights

8.1 Marketing Rights

Artists grant ACGGOODS the right to use submitted works for promotion (mockups, social media, ads).

8.2 Scope

The platform will not resell artwork files or use them outside the agreed collaboration.

9. Governing Law and Dispute Resolution

9.1 Jurisdiction

This policy is governed by the laws of the Hong Kong Special Administrative Region.

9.2 International Standards

Both parties shall comply with international conventions, including DMCA procedures where applicable.

9.3 Dispute Resolution

Disputes shall first be resolved through negotiation. If unresolved, they shall be submitted to the courts of Hong Kong SAR.
